Court: Vonage Doesn’t Have to Pay Into Nebraska’s USF

Vonage Holdings Corp. this week won its first court victory in a long time.

A Nebraska district court agreed with the New Jersey-based VoIP provider that it shouldn’t have to contribute to Nebraska’s Universal Service Fund (USF). The court said only the FCC has jurisdiction over VoIP providers when it comes to USF.

Vonage had argued that there’s no way to separate interstate and intrastate VoIP traffic, meaning it should only have to pay into the federal USF.

Nebraska’s Public Service Commission, which oversees the state’s USF, has until April 2 to decide whether to appeal the ruling.

The case marks Vonage’s first court win since losing a series of patent infringement lawsuits last year.
